These Terms of Use (these “Terms”) represent an agreement between you and Invest in Education Foundation, Inc. (the “Foundation,” “we,” “our,” “us”) and govern your use of our website (the “Site”) at investineducation.org. By using the Site, you acknowledge that you have read, understood, and agree to be bound by and comply with these Terms.

Who we are

The Foundation is a research and policy organization that promotes improvements in education for students, increasing educational choice, and working to close gaps in educational achievement. We have been recognized by the Internal Revenue Service as a not-for-profit public charity under Section 501(c)(3) of the Internal Revenue Code. You may obtain a copy of organizational and other documents for the Foundation by contacting the Charities Bureau of the New York State Attorney General or us at the notice address at the end of these Terms. Comments

Some of the information we may collect when you use the Site may pertain to you or allow you to be identified (“Personal Data”). Examples of Personal Data, which you may choose to provide, may include contact information such as your name, the name of your organization, postal and email addresses, and phone number. We use Personal Data to fulfill users’ requests; respond to questions or comments; allow contractors to provide services for us related to the Site; communicate information, or allow others to communicate information, consistent with our mission; and/or for other purposes as described in this privacy policy or specified on the Site.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Communicating with You: We may use your Personal Data for the purpose of communicating with you, or allowing others to communicate with you, about matters consistent with our mission, and to respond to your inquiries.

Surveys: We may ask you to complete surveys or opinion polls from time to time. If we do so, participation will be voluntary, and we will only use the information that we collect in an aggregate manner, not in an individually identifiable form.

Donations or Purchases: Although we do not currently offer these features, if we ever provide an opportunity for users of the Site to make online donations or purchases, we will ask you to provide Personal Data, including your name, postal and email addresses, telephone number and payment information, which we or our third-party payment processor will use to process the transaction. We might also add your contact information to our mailing lists.

Inquiries: If you send us a comment or question, we will retain the information that you provide to us for the purpose of responding to you, as well as for improving the Site.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

We maintain web logs that automatically record basic information about everyone who visits the Site. We use web log information to help us improve the Site, to identify popular features, and for other administrative and analytic purposes. We may also use web logs to help identify any person who may be misusing the Site. These logs may contain:

· Your IP address.

· The type of browser and operating system that you use.

· The date and time you visited a Site.

· The pages that you visited on a Site.

· The address of the website you linked from to get to a Site.

We use cookies, web beacons and/or similar technologies to help you navigate the Site, to allow us to learn how you use the Site, and to improve the Site. Cookies are text files we place in your device’s browser to store your preferences. Cookies, by themselves, do not reveal any Personal Data unless you choose to provide this information to us by, for example, registering at a Site. However, once you choose to provide Personal Data to the Site, this information may be linked to the data stored in the cookie. If you decide not to permit cookies on your device, this may affect your ability to use the Site. From time to time, the Foundation may engage third parties to track and analyze usage information regarding individuals who visit the Site, using cookies or other technologies. The use of cookies and similar technologies by our partners and service providers is not covered by our privacy policy. We do not have access to, or control over, these cookies.

We use certain third-party tools to provide features and functionality on the website. For example, we use Google Tag Manager, which allow us to integrate tracking or statistical tools and other technologies, and facilitate the delivery of content, on the Site. These tools do not create any user profiles or store cookies, but they may collect your IP address, which may also be transferred to Google. We also use a third-party service, currently Font Awesome, provided by Fonticons, Inc. so that when you call up a page, your browser correctly loads iconography and symbols. For this purpose, the browser you use must connect to the servers of the service provider. This allows the service provider to know that your IP address has been used to access this Site. The Foundation may use web beacons alone or in combination with cookies to compile information about how people use the Site and interact with our emails. Beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular website tied to the beacon, and a description of a website tied to the beacon. For example, we may place beacons in emails that notify us when you click on a link in the email that directs you to one of the Site. We may use beacons to operate and improve the Site and email communications.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

Other Organizations: We may share Personal Data with other organizations for purposes consistent with the objectives of the Foundation.

Service Providers: We contract with third party service providers to perform functions for us. These service providers may be given access to the information we collect for the purpose of performing those functions, but they will be contractually bound to maintain the confidentiality of the information and not to use it for any other purpose.

Mergers or Transfers: If we were to merge with, or transfer all or substantially all of our assets to, another organization, one of the assets we would likely include in the transfer is our database of Personal Data.

Disclosures for Legal Reasons: We will disclose Personal Data when we are required to do so by law, regulation or other legal requirement, for example, in response to a court order or subpoena. We also may disclose such information in response to a law enforcement agency’s request or when we believe such disclosure is appropriate to protect our legal rights or to protect anyone’s property or safety.

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

We take reasonable steps to ensure that the Personal Data we collect is reliable for its intended use, accurate, complete and current. If you would like us to stop sending you email or other communications or would like to access your Personal Data to review, correct or delete it, you may send us a request at [email protected]. We will endeavor to satisfy such requests within a reasonable time.

How we secure your information

We use reasonable means to safeguard the security of Personal Data and prevent unauthorized use, disclosure, destruction, and changes of data. However, security can never be foolproof on the Internet, and we cannot guarantee the security of your Personal Data. Moreover, because Internet communication is unsecure, the Personal Data you supply to us or your access of any information via the Site could be intercepted during transmission.
